The Register of Wills is a constitutional office in Maryland, with one Register elected in each county and Baltimore City. Each Register serves a four-year term, concurrent with the gubernatorial election.
The Register appoints personal representatives to administer decedents’ estates, overseeing timely and proper administration of these proceedings.
The office also: assists the public in preparing required forms; maintains permanent records of all proceedings; serves as Clerk to the Orphans’ Court; monitors estates and refers delinquent matters to the Court; determines and collects inheritance taxes and probate fees/court costs; audits accounts of personal representatives and guardians; issues court notices and orders to involved individuals; and verifies compliance with court orders. The office also provides will safekeeping services for the living.
Probate literally means to prove, as in proving a person’s will. It can be handled administratively at the Register of Wills or, when necessary, judicially by the Orphans’ Court. It involves gathering assets, paying all creditors, and distributing all property titled in the decedent’s name to the beneficiaries named in the will or those who would inherit under intestacy laws (dying without a will).
